The Western Governors’ Association has indicated its support for the Environmental Protection Agency (EPA) decision to not issue final regulations requiring financial assurance for hardrock mining facilities to Administrator Scott Pruitt.
Section 108(b) of the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) “was developed without meaningful consultation and was duplicative of state programs,” asserts the letter sent on Feb. 23, 2018.
“EPA’s announcement of its decision acknowledges that the agency did not consider state programs when determining the need for the proposed rule and that this lack of consideration was inappropriate” wrote WGA Executive Director Jim Ogsbury. “Western Governors look forward to working with an EPA that recognizes states as partners and considers the impacts of its actions on states.”
