WGA shares policy, process improvements as EPA considers revising aspects of Clean Water Act

The Western Governors’ Association shared policy resolutions about water in the West, as well as process improvements to ensure the effective administration of state authority, for the U.S. Environmental Protection Agency to use as it reconsiders the Clean Water Act Section 401 Certification Rule. In addition to the policy resolutions Water Quality in the West and Water Resource Management in the West, the outreach of July 28, 2021, shared by WGA Executive Director Jim Ogsbury also included “Clean Water Act Section 401: Process Improvements and the Preservation of State Authority.” “Given the states’ primary role in establishing water quality standards, EPA should directly involve the states in the rulemaking process for any proposed changes to its existing regulations,” the letter read.
