WGA calls on the EPA to allow for flexibility in state air quality and emissions programs

In correspondence with the Senate Committee on Environment and Public Works, The Western Governors’ Association conveyed the importance of cooperative federalism when implementing the Clean Air Act (CAA) and air quality management. The letter of April 6, 2023, signed by WGA Executive Director Jack Waldorf, specifically called on the Environmental Protection Agency to recognize state authority under the CAA and allow for flexibility when reviewing air quality and emissions programs that are tailored to individual state needs, industries, and economies. “EPA should not reject reasonable state policy choices based solely on national consistency, fear of being legally challenged, or on concerns that such choices might not be appropriate for all states,” the letter read.
