Governors seek clarity on Section 404 of CWA, One Federal Decision Policy on infrastructure


Western Governors seek to better understand the Administration’s goals and plans for state delegation and infrastructure permitting and environmental reviews.

In an effort to achieve that goal, the Governors shared observations and questions with the White House and federal agencies on Oct. 10, 2018 regarding the Clean Water Act's Section 404. The Governors additionally inquired about the Administration’s actions concerning state delegation, permitting and environmental review in the One Federal Decision policy, the White House’s Legislative Outline for Rebuilding Infrastructure in America.

"The answers to these questions will help western states better understand the Administration’s plans and goals regarding CWA and infrastructure permitting and environmental review, as well as the opportunities for expanded state delegation in these areas," noted the letter signed by WGA Chair and Hawaii Gov. David Ige and Vice Chair and North Dakota Gov. Doug Burgum.

In addition to the White House, the letter was sent to the Council on Environmental Quality, the U.S. Army Corps of Engineers and the Environmental Protection Agency.
