COMMENTS: Governors submit recommendations to EPA on meaningful state consultation on CERCLA regulatory process

Western Governors sent a letter on June 30, 2017 to U.S. Environmental Protection Agency (EPA) Administrator Scott Pruitt on the agency’s proposed rule “Financial Responsibility Requirements Under CERCLA § 108(b) for Classes of Facilities in the Hardrock Mining Industry.” The governors recommended, in part, that if EPA determines it will move forward with CERCLA 108(b) regulation for hardrock mining, the Proposed Rule needs to be rewritten with adequate state-federal consultation and provide exemption for state programs that meet certain criteria.
